1. General

Welcome to ECUfiles (hereinafter referred to as “the Site” or “the Platform”). By using the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree to these terms, please stop using the Site immediately.

2. Scope of Services

The Site provides global ECU file–related technical services, including but not limited to:

• ECU file modification (Stage1/2/3, DTC Off, DPF/EGR/AdBlue Off, etc.);
• ECU file repair (checksum correction, structure repair);
• Automated tools (AutoChecksum, AutoDTC, VIN decoding, file comparison);
• File upload, online processing, and paid download services;
• Technical support and consulting services.

The Site does not provide any hardware or physical products.

3. Global Eligibility

The Site is intended for users worldwide. By using the Site, you confirm that:

• You are at least 18 years old;
• You legally own the vehicle or have proper authorization to work on it;
• The files you upload are obtained lawfully;
• You will not use the Site’s services for any illegal purposes (including but not limited to emission cheating or illegal modifications).

4. Global Regulatory Compliance

Many regions have different regulations regarding emissions and vehicle modification, including but not limited to:

• EU EURO5/6 emission regulations;
• US EPA / CARB regulations;
• UK MOT emission and roadworthiness tests;
• Canada CEPA regulations;
• Australia Clean Air Act;
• China Air Pollution Prevention and Control Law.

You are solely responsible for ensuring that the use of any files from the Site complies with the applicable laws and regulations in your country or region.

5. User Responsibilities

By using the Site, you agree to:

• Upload only lawful and authorized files;
• Not use the Site’s services for insurance fraud, emission cheating, illegal racing, or any other unlawful activities;
• Not attempt to crack, attack, or abuse the Site or its services;
• Not copy, resell, redistribute, or otherwise misuse any algorithms, outputs, or files provided by the Site.

6. Technical Risk Disclaimer

ECU file modification carries inherent risks, including but not limited to:

• Flash/write failure;
• ECU damage;
• Engine and/or gearbox damage;
• Failure to pass inspection or MOT;
• Emission system malfunction;
• Legal and regulatory risks.

By using the Site, you acknowledge and accept that you bear all such risks yourself.

7. Limitation of Liability (Worldwide)

To the maximum extent permitted by applicable law, the Site shall not be liable for:

• Direct losses;
• Indirect, incidental, or consequential losses;
• Special or punitive damages;
• Any legal or regulatory risks incurred by the user;
• Any damage arising from the use of files or outputs generated by the Site.

In any event, the maximum aggregate liability of the Site shall not exceed the total amount paid by the user for the specific service giving rise to the claim.

8. Account Security

You are solely responsible for maintaining the security of your account and login credentials. The Site shall not be liable for any loss or account suspension caused by your own actions, negligence, or sharing of credentials.

9. Service Modification / Termination

The Site reserves the right, at its sole discretion, to:

• Modify services;
• Terminate services;
• Adjust pricing;
• Update or change these Terms.

Such changes may be made at any time without prior notice. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

GOVERNING LAW- These Terms of Service and any United Kingdom agreements whereby we provide you Services shall be governed by and construed in accordance with the law of Hong Kong;

We shall not misappropriate any database, nor shall we modify the relevant programs after completing the repair/service.
